How a new California law helps protect victims of stalking

Technology can be both beneficial and damaging for those experiencing domestic violence. Advances in technology make it easier for people to educate and protect themselves. They can also document what they experience by recording video footage of incidents or taking pictures of injuries.

Unfortunately, those with bad intentions can also use technology to harass or abuse others. Digital technology makes it easier than ever before for people to stalk others or scrutinize their interactions with other people. For example, GPS technology has become smaller and more accurate in recent years. Additionally, vehicles are much more technologically advanced.

Abusive and violent individuals can use the technological systems built into modern vehicles to stalk, harass and intimidate their victims. California has recently adopted a new law that helps protect victims of domestic violence and stalking from abusers who want to use the victim’s vehicle as a tool for stalking.

What is the new law in California?

Lawmakers have recently adopted a new regulation that can protect people from abuses of technology in domestic violence scenarios. Under a new statute, which moved through the state legislature as SB 1394, victims of domestic violence or stalking seeking relief from that conduct can ask vehicle manufacturers to help them.

The law now requires that vehicle manufacturers must eliminate an abusive individual’s access to connected vehicle systems, including GPS tracking, after receiving a request from the victim of the stalking. In theory, this new statute gives people protection that begins within just a few days of them notifying manufacturers of their concerns.

Making use of this law could be beneficial, especially when combined with a restraining order. The California courts can prohibit a spouse or romantic partner from following, communicating with or otherwise intimidating another person.

Restraining orders don’t necessarily eliminate bad behavior, but they give victims the ability to call the police and may result in consequences if people violate the restraining order. Those dealing with stalking or domestic violence may have a hard time asserting themselves and connecting with the various protections available under state statutes.
