Common small business legal disputes

On Behalf of | Feb 9, 2018 | Business Law

When we think about business lawsuits, sometimes we think mainly on international large corporations with legal disputes of millions of dollars. However, medium and small businesses are not safe from legal claims.

If you’re a business owner or are planning on opening a business, we’d like to share with you some of the most common claims we have seen with small to medium size business clients.

Employment issues. As a business owner its very important that you get familiar with the employment applicable laws for your area. An experience law firm can work with you and review your hiring and management process beforehand to help your business follow the laws and prevent any employment suits. Common suits can be harassment or wrongful termination.

Fraud. Having your company sued for fraud can sound very scary. After all, fraud suits are the result of malicious actions to your costumers. We seriously doubt that anybody would open a business to maliciously take advantage of people. However, a legal ambiguity in your company’s product or service development may become a nightmare. An attorney with experience in business law cases can assist you in the early stages of your product or service development to help you prevent this type of claims.

Contract disputes. Small businesses also must deal with a large variety of contracts, whether these are credit loans, business rentals, or agreements with clients or vendors. An agreement with a third party, even if its not in writing, its legal binding and if breached you can be legally held accountable. Most businesses have an internal legal affairs department that takes care of most legal issues for the business, however if you’re just starting your business, we recommend you consult with an attorney regarding the contracts your business handles with third parties.

Intellectual property. You may not be aware that you’re violating someone else’s intellectual property by using graphic materials you found online or using their logo. Malicious or not, intellectual property theft it’s a serious claim. Make sure your business doesn’t do anything wrong by reviewing your internal processes and consulting with an attorney.
